Terms governing use of the TopTable Cloud restaurant POS service.

By accessing or using TopTable Cloud services provided by Rideware Technologies LLC ("Company", "we", "us"), you agree to be bound by these Terms and Conditions. Please read them carefully before using our services. If you do not agree, do not use our services.

1. Definitions

  • "Service" means the TopTable Cloud restaurant management platform including POS, KOT, QR Menu, Waiter App, Inventory and related modules.
  • "Subscriber" / "You" means the restaurant, business or individual that subscribes to the Service.
  • "Subscription" means a monthly paid plan (Starter, Growth, or Premium) giving access to the Service.
  • "Content" means your restaurant data including menus, transactions, inventory, customers and reports stored in the Service.

2. Service Description

TopTable Cloud is a cloud-based restaurant management platform. The Service is provided on a subscription basis. Features available to you depend on the plan selected. We reserve the right to add, modify or discontinue features with reasonable notice.

3. Subscriptions & Payment

Plans & Billing

  • Subscriptions are billed monthly in advance in UAE Dirhams (AED).
  • Current plan prices are listed on our Pricing page. We will notify you at least 30 days before any price changes.
  • Payment is due at the beginning of each billing period. Failure to pay may result in suspension of the Service.
  • All prices are exclusive of UAE VAT (5%) where applicable.

Add-Ons

Additional modules and services (add-ons) are charged separately from your base plan subscription. Add-on pricing will be communicated to you before activation.

4. Cancellation Policy

  • You may cancel your subscription at any time by providing written notice (email or WhatsApp) to our team.
  • Cancellations take effect at the end of the current billing period. No partial refunds are provided for unused days in the current period.
  • Annual or multi-month prepaid plans: refunds may be available for unused full months, at our discretion.
  • We may cancel or suspend your subscription immediately if you breach these Terms.

5. Acceptable Use

You agree to use TopTable Cloud only for lawful purposes. You must not:

  • Use the Service for any illegal or fraudulent activity
  • Attempt to reverse engineer, copy or resell the Service
  • Share your account credentials with unauthorized parties
  • Upload or transmit malicious code or content
  • Interfere with or disrupt the Service infrastructure
  • Use the Service to store data of persons under 18 without proper consent

6. Your Content & Data

  • You retain full ownership of all Content (menu data, sales data, customer data, etc.) you input into TopTable Cloud.
  • You grant us a limited licence to process your Content solely to deliver the Service.
  • You are responsible for the accuracy and legality of Content you input.
  • Upon account termination you may request a data export within 90 days. After 90 days, data is deleted.

7. Service Availability

We aim for 99% uptime. Planned maintenance will be communicated in advance. We are not liable for downtime caused by force majeure, internet outages, or third-party service failures beyond our reasonable control.

8. Intellectual Property

TopTable Cloud, its software, design, branding, logos and documentation are the intellectual property of Rideware Technologies LLC. No part of the Service may be copied, reproduced, modified, or distributed without our written consent.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY UAE LAW: (1) WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE SERVICE. (2) OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE SUBSCRIPTION FEES PAID BY YOU IN THE 3 MONTHS PRECEDING THE CLAIM.

10. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Indemnification

You agree to indemnify and hold harmless Rideware Technologies LLC and its officers, employees and agents from any claims, damages, losses or expenses (including reasonable legal fees) arising from your use of the Service, breach of these Terms, or violation of any law or third-party rights.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates (UAE). Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a website notice at least 30 days before the changes take effect. Continued use of the Service after changes take effect constitutes your acceptance.
